These terms, conditions and any associated information contained within our electronic web site or any other brochure or other document may form or be part of a contract between you, the client, and us, the service provider. However, no contract shall exist until a written confirmation has been received with deposit or full payment, as applicable, and a confirmation invoice issued by us.
Deposits
Please check for availability and prices before booking. All payments to be made in GBP / Euros as directed. We require a nonrefundable 25% deposit per booking and within 5 days of the provisional booking in order to secure your reservation. If your deposit payment is not received within these 5 days then the holiday may be offered to other interested parties. Upon receiving your deposit we will send confirmation of your reservation, a booking reference and information about your holiday. In the case of parties or groups comprising more than one individual, the client who pays for the booking will be liable for all persons in the party, both in terms of payments and ensuring compliance with these terms and conditions. If the booking date is less than 6 weeks before the holiday then the full payment is required at the time of booking.
Payments
Full payment must be received no later than 6 weeks prior to your arrival. If full payment is not received by the due date, the booking may be treated as a cancellation and any deposit paid may be forfeited. Bookings made within 6 weeks of your arrival date must be paid in full at the time of booking. All payments to be made in GBP or Euros as described.
Payments should be made GBP or Euro as requested by the following methods
- Electronic bank transfer
- Personal cheque
- PayPal. Please note a 3.4% surcharge will be added to your bill as levied by PayPal. This does not include the Security Bond which can be held and returned via PayPal for no charge
Security Bond
A £150/€180 security bond is required when you pay your remaining balance and will be held by us and returned to you immediately after your holiday providing we have confirmation no damage has occurred during your stay.
We have an Internet connection via a Vodafone USB connection stick available on request. A further £150/€180 security deposit is required for this, again refundable on return, on confirmation of its return.
Cleaning and Maintenance
Cleaning is kept to once a week to maintain your privacy, however if you require additional cleaning and linen changes, this can be organised for a small local charge.
Pool Maintenance will be carried our 3 times per week. The staff are polite and helpfull and works are carried out in a way to minimise disruption.
Amendments by the Client
If you wish to change any details of your booking you must inform us as soon as possible and confirm the details in writing (an acknowledged e-mail is sufficient). If we are able to accept the change* we will charge an amendment fee of £25 per person for each booking change. However, any changes made within 60 days of arrival may be treated as a cancellation and cancellation charges will apply as shown. If the change is to increase the number of persons booked no amendment fee or cancellation charge will apply. A change of name for arrangements exactly as booked does not constitute an amendment. *We cannot guarantee that it will be possible to change dates within six weeks of your arrival, in which case the
below listed schedule of charges may apply. We will however make every effort to accommodate your changes.
Cancellation by the Client
Cancellation shall take effect only when we receive written notification from the person signing the booking form. In all cases of cancellation the deposit and any amendment charges will be forfeited. The following cancellation fees, expressed as a percentage of the total accommodation costs, will become immediately payable to us.

Alterations by Us
Arrangements for holidays are made many months in advance, and changes can occur. We reserve the right to alter our details before and after any booking has been confirmed. Most of these changes are minor and in all cases we will advise you at the earliest possible date. If a significant change becomes necessary you will have the choice of accepting the change in arrangements or cancelling your holiday and receiving a prompt and full refund. However, we cannot be liable for other costs that you may have incurred in relation to your holiday.
Limit of liability
We regret that we cannot accept liability or offer any compensation if we are forced to cancel, curtail or in any way change your holiday or if the performance or prompt performance of our contractual obligations is prevented or affected by circumstances amounting to ‘force majeure’. Such circumstances shall include, but are not limited to, war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, technical problems with transport, adverse weather conditions and similar events beyond our control.
Client Liability
We and our employees shall be entitled to recover from the client the cost (estimated if not precisely known) of any damage caused by the client. The client undertakes to behave in such a manner as to not cause distress, damage, danger or injury to neighbours or employees and to behave in such a manner so as not to spoil the enjoyment of others in the surrounding area. The stay of any client in breach of this clause shall be terminated forthwith and we shall have no further contractual obligations towards him or her. As such, the breach of this clause by any one client may cause us to demand immediate vacating of the accommodation by every client on the booking form.
Villa Petalutha Liability
We accept responsibility for ensuring that the accommodation you book with us is supplied as described and that the services offered reach a reasonable standard. In the case of loss and /or damage to personal possessions (including money), we have no liability as you are assumed to have taken out the appropriate insurance cover before travelling. We carry appropriate liability insurance for the operation of our business.
Arrival and Departure
In general, rooms are available from 16:00 hours on the day of your arrival. We ask that all rooms be vacated by
10:00 hours on the day of your departure.
Accuracy
The information published either electronically or within any brochure or document, is correct to the best of our
knowledge at the time it was published. Villa plans and resort maps should only be used as an indication of layout.
Furniture and room arrangements are subject to change.
Complaints
Should a problem arise during your holiday please inform a member of staff as soon as possible. We will make
every effort to amend the problem. We are sorry that any complaint made after your departure will usually be
difficult or impossible to rectify.
Exclusions
Your holiday price does not include:
- Holiday insurance
- Transfers to and from airports.
- The cost of flights and other travel arrangements
- Room supplement for reduced occupancy
- The handling fee, if payment for your holiday is by PayPal
- Banking charges associated with making payments to our account.
- Beach Towels are not provided and bath towels are not to be used outside the Villa.
- Pets: For the comfort of all our guests and for safety reasons pets are not allowed.
Passports
It is your responsibility to ensure that you are in possession of all necessary travel and health documents prior to
departure from your home country. All costs incurred in obtaining such documentation must be paid by you. We
regret we will not accept any liability if you are refused entry onto any transport or into any country due to the failure on your part to carry correct documentation. If you or any member of your party is not a British citizen, or
holds a non-British passport, you must check passport and visa requirements with the Embassy or Consulate of the
country (ies) to or through which you are intending to travel. If failure to have any necessary travel or other
documents results in fines surcharges or other financial penalty being imposed on us, you will be
responsible for reimbursing us accordingly.
Non-smoking chalet
For the comfort of all our guests and for safety reasons Villa Petalutha is a non-smoking Villa. Ashtrays are provided for those wishing to smoke outside. Any breach of this clause shall be regarded as a material breach and may result in the client being removed from the Villa.
Insurance
We will not be responsible
for meeting any sums which should have been covered by insurance in the case of repatriation or medical expenses
incurred by you. |
